The 87th Legislature passed SB 516 to increase penalties for ATM “smash and grab” and “hook and chain” criminals. The bill makes the impairment or interruption of service to an ATM a third degree felony, which is punishable by up to 10 years in jail and a fine of up to $10,000. In order to raise awareness of this new statute, TBA, in collaboration with the Combined Law Enforcement Association of Texas (CLEAT), has produced stickers for placement on your ATMs and ATM gates. Placement of these stickers on ATMs is not required by Texas law; however, we believe these stickers will not only warn criminals of the new felony penalties, they will also alert law enforcement and local prosecutors of the section of the Texas Penal Code (Sec. 28.03) under which ATM hook and chain crimes may be prosecuted.
