Given the short time period and relatively minor expense involved in a nonjudicial foreclosure in Texas, the Bank will most often utilize this alternative, rather than pursue a judicial foreclosure. Considering that, in order to extinguish junior liens, the Bank may ultimately have to foreclose on property it has already received by deed in lieu of foreclosure, the Bank will most often choose nonjudicial foreclosure over acceptance of a deed.
