RESPA requires a servicing transfer statement to be sent to the consumer if the loan servicer sells or assigns the servicing rights to a borrower’s loan to another loan servicer. The loan servicer must notify the borrower 15 days before the effective date of the loan transfer. The notice must include (i) the effective date of the transfer, (ii) the name and address of the new servicer, (iii) toll-free telephone numbers, (iv) the date the new servicer will begin accepting payments (which may not be same date), (v) whether the transfer affects the terms or availability of optional insurance and (vi) a statement that the transfer doesn’t affect the terms of the mortgage (except as directly related to servicing) [12 CFR 1024.33].
