There is a “Means Test” which is a detailed formula that the Court must apply in determining whether an individual debtor’s income is low enough to file a chapter 7 case or it is high enough that the case should be dismissed or converted to a case under chapter 11 or chapter 13. It is based on the cost of living in the debtor’s location, the debtors disposable income and level of debt.
