A Deed of Trust, Mortgage, Builders & Mechanics Lien Contract or other written document signed by the owner of the collateral in which the owner grants the Bank a lien on specifically described real estate to secure a debt owed to the Bank by the owner or some other person. This document is filed in the Real Property Records in the County in which the property is located. A list of Texas Counties, their county seats and zip code is located in Chapter 1. The lien document commonly contains representations and warranties, covenants and events of default. Chapters on specific types of real estate loans discuss the appropriate lien document. A sample Deed of Trust (With Future Advance Clause) is located at the end of this Chapter. It would be appropriate to secure a line of credit secured by non-homestead property.
