1. Insert the name of the county where the homestead property and the non-homestead property is located. If the properties are in two different counties, prepare an Affidavit for each county.
2. Insert the date - month, day and year.
3. Insert the Affiant’s name.
4. Insert the street address and the legal description of the Affiant’s homestead such as:
6500 Wroxton, Houston, Harris County, Texas 77005 described as follows: Lot 4, Block 100, Johnson Hunter Survey, Harris County, Texas according to the plat recorded in Volume 60, Page 112, Deed Records of Harris County, Texas.
5. Insert the street address and legal description of the Affiant’s non-homestead property such as:
1408 Beach Drive, Galveston, Galveston County, Texas 77999 described as follows: Lot 1, Block 7, Robert Miller Survey, Galveston, Galveston County, Texas according to plat recorded in Volume 60, Page 112, Deed Records of Galveston County.
6. Insert the name of the Bank.
7. Insert the Bank’s address - number, street, city, county, state, zip code.
8. Insert the loan number and a brief description such as “Loan No. 54321-$14,000.00 personal loan.”
9. Have the Affiant sign the Affidavit.
10. Have a notary public notarize the Affidavit.
