The forms located at the end of this Chapter appear in the following order:

        Notice Concerning Extensions of Credit Defined by Section 50(a)(6), Article XVI, Texas Constitution (VMP8080 (TX)) (available at www.fc.texas.gov). 
This notice explains the terms and conditions of a home equity loan under Texas law.  This notice must be given to the borrower when a home equity loan is made.  This is a English version of the notice.  The Finance Commissioner has also promulgated a Spanish version.

        Notice Concerning Refinance of Existing Home Equity Loan to Non-Home Equity Loan
Under Section 50(f)(2), Article XVI, Texas Constitution (available at www.fc.texas.gov) (VMP8084 (TX))

        Receipt of Documents (HE-RECPT-TX) (12/30/2011)

        Real Estate Home Equity Deed of Trust (Cash Out-First Lien) (RE-HEDT1-TX) (1/1/18). 
This is the first lien deed of trust for home equity lending in Texas under Chapter 1 of the Credit Code.  It cannot be used as a substitute for FNMA, FHLMC, FHA or VA forms.

        Real Estate Home Equity Deed of Trust (RE-HEDT3A-TX) (1/1/18). 
This is the second lien deed of trust for home equity lending in Texas under Chapter 3A of the Credit Code.  It cannot be used as a substitute for FNMA, FHLMC, FHA or VA forms.

        Acknowledgment of Fair Market Value of Homestead Property for Texas (AFF-FMV-TX) (7/1/2017). 
This form is required in closed-in home equity transactions.  The lender and owner must execute an acknowledgement of fair market value of the homestead property on the date of the extension of credit.  The AFF-FM-TX combines an affidavit of homestead and this certificate of fair market value.  The document also provides our customers with the opportunity to verify that the loan was closed on a particular date at the office of the lender, a title company, or an attorney at law.

        Texas Home Equity Real Estate Note (Cash Out-First Lien) (REN-1-TX) (12/1/2019). 
This form is used as a note for consumer first lien closed end home equity loans defined by Section 50(a)(6), Article XVI, of the Texas Constitution written under Chapter 1 (first lien).  It may be used for loans with either fixed or variable rates.

        Texas Home Equity Real Estate Note (REN-3A-TX) (12/1/2019). 
This form is used as a note for consumer first lien closed end home equity loans defined by Section 50(a)(6), Article XVI, of the Texas Constitution written under Chapter 3A (second lien).  It may be used for loans with either fixed or variable rates.
