Pursuant to the Deficiency Statute, fair market value shall be determined by the finder of fact after the introduction by the parties of competent evidence of value. Since a debtor who is sued for the deficiency on a note has the right to request a jury trial, the finder of fact, in those cases in which the debtor requests jury trial, will be the jury. Otherwise, the finder of fact will be the judge. Presumably the judge could, however, determine the fair market value of the property, notwithstanding the verdict of the jury, if the jury’s determination is against the great weight of the evidence. It appears to be the legislative intent that fair market value be determined by the finder of fact, whether judge or jury.
