                                BEFORE ME, the undersigned authority, on this day personally appeared Affiant and after being by me duly sworn according to law, did depose and say:

 

                                I do not now and do not intend to ever in the future, reside on, use in any manner or claim my Nonhomestead property described above as a business or residence homestead.  I further renounce and disclaim any and all homestead rights, interests, and exemptions related to the Non-homestead Property.

 

                                I further designate the property described above as my Homestead Property, the only homestead to which I am entitled.

 

                                I now own and reside on, use, claim and designate the Homestead Property described above as my only legal homestead, exempt from forced sale under the Constitution and laws of Texas.

 

                                This designation and affidavit is made to induce Lender to make a loan secured by a deed of trust or a builder’s and mechanic’s lien contract on the Non-homestead Property described above.
