If the Bank has a priority lien on leasehold improvements ahead of all owners and mortgagees of the real property the Bank may, upon default, remove the borrower’s tenant fixtures from the leased premises. However, the Bank must pay for any damage caused by the removal unless the owner or mortgagees have agreed otherwise. The Bank may be required to give adequate security for these costs. The Bank should not be responsible for any loss in value of the real property caused by the absence of the fixtures or by necessity of replacing them.
