A utility security instrument received by the Texas Secretary of State will be accepted for filing if:
•The title page conspicuously states: “This Instrument Grants a Security Interest by a Utility;”
•There is payment of the statutory filing fee; and
•There is sufficient identification of the parties to ensure proper indexing (the name and address of the utility must be clearly identified within the security instrument).
Upon acceptance, the Secretary of State will stamp each utility security instrument with a consecutive security instrument file number. A duplicate original or copy should also be submitted along with a self-addressed stamped envelope if a filed copy is desired as an acknowledgment.
