Amount of Guaranty

A well-drafted guaranty will carefully describe the  obligations of the borrower for which the guarantor is to be responsible.  In most cases, these will include the loan and all other obligations of the borrower under the note and the other loan documents.  Some attorneys recommend that the guaranteed obligations specifically include interest which accrues on the loan after the filing of any bankruptcy petition with respect to the borrower.  As noted below, the definition of guaranteed obligations should expressly include any indebtedness of the borrower arising by reason of disgorged payments.
